Practicing MBE Questions

In order to do well on the MBE, you must know the fine distinctions of the law. You can study those fine distinctions by studying your outlines and then by working on questions.

It is not enough for you to work on the questions, review the answers and then move on. You must understand why you picked the right answer or the wrong answer. That is why you must read the explanation carefully, reading each answer choice explanation, whether right or wrong.

If you missed the question, ask yourself why you missed the question. Did you miss it because you didn’t know the law, didn’t know the facts or didn’t know the “trick” of the question? Sometimes with cursory reading of the fact pattern, you miss certain clues of law, certain facts that now seem important or even a confusion of what actually happened in the fact pattern. Sometimes you misapply the facts to the law.

Analyzing the question and the answer choices will help you understand if there is a pattern to your misses or if there are holes in your analysis.

Positivity Will Determine Success or Failure

Positivity will determine whether you pass or fail. You must stay positive as you prepare for the exam bar. Those who think that this is only a small bump in the road and attack their exam with confidence and positivity, will end up being successful on the bar exam. Those who don’t truly, absolutely think they will pass the bar exam will become a self-fulfilling prophesy of doom. A depressed attitude will drag you down like nothing else will – even if you know the material.

You can either be someone who passes the bar exam or someone who doesn’t. It’s your choice to make. Tell yourself every day that you will pass the bar exam and believe it.

6 weeks until the Bar Exam: Where Should You Be Today?

There are 6 weeks until the bar exam.  Where should you be today?

Follow Your Schedule

By this time you should have set a realistic work schedule that allows for lecture time, review time, practice time and relaxation time.

Maintain your concentration level by varying your study activities, i.e. if you are reading an outline and losing focus, start practicing questions.

Know Your Law

You should be trying to commit to memory the black letter law.  Knowing the law means that you internalize the material in such a way that you truly “own” it and can spit it out on demand.  This does not mean that you recognize the material or it seems familiar to you.  The bar exam requires you to know the rules with precision and specificity and to have a solid understanding of the rules.

Continue to do practice questions, essays and performance tests.

Know Your State Bar Exam

You should know your bar exam like the back of your hand.  Everyone must prepare for the MBE, but you should know the ins and outs of your state exam. Tailor your studies to your state exam.

North Carolina Central, Arizona Summit Latest Schools to be Out of Compliance with ABA Accreditation Standards

The ABA recently notified two law schools—North Carolina Central University School of Law and Arizona Summit Law School—that they were not in compliance with specific accreditation standards. Further, the ABA released a December 2017 accreditation committee decision that the Appalachian School of Law remains noncompliant with Standards 501(a) and 501(b), which deal with law school admissions.

Regarding North Carolina Central, the Jan. 4 letter states that the accreditation committee found that the law school is not in compliance with Standard 501(b) and Interpretation 501-1, which states that factors to consider in determining compliance include academic and admission test credentials, the school’s academic attrition and recent graduates’ bar passage rates. For July 2017, NCCU’s pass rate was 57%, below the 72% pass rate for the state.

The Jan. 4 noncompliance letter regarding Arizona Summit and was placed on probation by the ABA in March, states that the school is out of compliance with Standard 202(a) – which is the financial resources issue – but they are also battling very low bar pass rates.

Appalachian is still not in compliance with the ABA standards – it also has very low bar pass rates.
