Now, It’s the Law Schools Crying Game – Meeting the New ABA Standard When Even Their First Time Taker Rate Is Poor

We have spoken to a number of law schools upset with the new ABA rules that require the law schools to be in compliance with the revised version of Standard 316, The revision version mandates that at least 75% of a law school’s graduates who sat for a bar exam must pass within two years of graduation. Under the previous rule, there were various ways to meet the standard, but now it’s a straight two year compliance that includes all the law schools students, including first time takers and repeat takers. It’s an almost impossible scenario for many law schools.

The first time that law schools would be subject to the revision is spring 2020, when the law schools file their complete bar passage rates of 2017 graduates. Like the old version of Standard 316, once it’s determined that a law school does not meet the standard requirements, they have two years to come into compliance.

It’s about time that law schools be held responsible for its law graduates bar exam passing rates, including the repeat takers who are at high risk and struggle to pass the bar exam. It is unacceptable for a repeat taker to take the bar exam 2, 3, 4, 5+ times, as their chances of passing dramatically goes to single digits.

Most students go to law school to become lawyers. Becoming a lawyer requires passing the bar exam. How well a school’s graduates perform on the bar exam is a very important accreditation tool to assess the school’s program of legal education.

California and Georgia will be releasing their bar exam results today. California will release its results at 6 pm today. Washington, DC has not announced when it will be releasing its results, but in all likelihood, it should be today.
